The New Privacy Laws

From 21 December 2001, Pharmaceutical Professionals (Asia Pacific) Pty Ltd, ABN 24 080 343 773, will be required to comply with the Privacy Act 1988, as amended by the Privacy Amendment (Private Sector) Act. Accordingly, our policies on the management of personal information are bound by the National Privacy Principles (NPPs).

The Nature of our Business

Pharmaceutical Professionals is a professional services firm, which recruits and trains staff for the pharmaceutical and health care industries.

Implications for our Client Companies

By seeking our services, clients will consent to the collection, use and disclosure of personal information as contemplated by this Privacy Policy Statement. The assumption is that this will apply whether our clients are bound by the National Privacy Principles or an approved privacy code

What Sort of Personal Information is Held/Collected generally

The personal information we collect generally includes:

Any information, or an opinion, about an individual which pertains to his/her seeking employment. It can be sensitive information, such as racial or ethnic origin, or everyday data such as an address. It also includes third party opinions about work performance, work experience and qualifications.

We generally do not seek to collect sensitive information, unless it is necessary for what we do. We would only do so with your consent, or if required by law, or if necessary in connection with a legal or equitable claim.

To enable us to best assess an applicant's suitability for placement in a particular job, with a particular client and/or for training needs.

How Personal Information is Collected

We obtain most of your information from you directly, such as:

  • when you submit an application and/or resume to apply for our services
  • when you complete a registration form prior to interview
  • each time we contact you to update our records and/or your job seeking and training requirements
  • each time you contact us regarding your current job seeking requirements

Sometimes we may ask to collect particular personal information about you. Unless we have already done so, when or before we collect that information, we will take reasonable steps to inform you of:

  • the purposes for which the information is collected;
  • where applicable, any law requiring the information to be collected, and the main consequences if all or part of the information is not provided.

How We Collect from Third Parties - other ways we generally collect information include:

  • when we seek information from a referee
  • when we seek information post-placement regarding your performance in the work place.

How Personal Information is Held, generally

We hold your personal information in a combination of computer storage facilities and paper-based files. These facilities and records are located on site at our North Ryde premises.

Security is a high priority and our premises are well secured, alarmed and monitored for entry/exit by two reputable security companies. Electronic storage of all personal information is kept in a secure place on site. Certificates are held guaranteeing the secure, correct disposal of confidential materials.

How Personal Information is Used and Disclosed, generally
Your Consent

Sometimes we will ask you, the candidate, to consent to a disclosure or use of your personal information for a particular purpose. We may do so in writing, over the phone or on our website.

Other times, your consent will be taken to be given where you indicate to us that you wish to obtain information about our services.

We also may disclose or use your personal information without your consent in the following circumstances:

  • for a reasonably expected purpose which is related to the purposes for collecting the information as contemplated by this Privacy Policy Statement.
  • we reasonably believe it is necessary to assist an enforcement body to perform its functions, or
  • we suspect that an unlawful activity has been, is being or may be engaged in and the personal information is a necessary part of our investigation or reporting of the matter, or
  • we reasonably believe it is necessary to prevent a threat to life, health or safety, or
  • we are authorised or required by law to do so (eg, where information is required by bodies regulating us or in response to subpoenas or warrants), or
  • we have contracted an external organisation to provide support services and that organisation has agreed to conform to our privacy standards and to allow us to audit them for compliance, or
  • the disclosure is to a credit reporting agency in connection with extending credit to you or recovering from you amounts that you owe under any contract you may have with us.

We do not disclose your personal information to others, except in the following cases:

  • to our related companies
  • to organisations which provide services to us
  • to credit reference agencies or other credit providers
  • with your consent or where it is necessary to provide you with services
  • where required by law

We will ensure that each candidate has been directed to the Privacy Policy Statement before we collect his/her personal information.

Training

Each of our employees plays a role in collecting, handling or managing personal information and is trained to ensure that he/she understands the implications of the legislation as it relates to his/her job. Periodical reviews and audits of staff practices in relation to privacy policies will be carried out.

Raising General Awareness

We hold seminars or workshops about the introduction of compliance measures to meet the requirements of the NPPs

Access and Correction Rights
